Unfortunately I would point out that consistently what happens in times of trouble and fear (as in the two cases you cite) the Constitution is routinely thrown out the window. The US Government and populace (and possibly every other government and populace in the world) will have to change fundamentally in order for the same not to happen at the next crisis.
